These Terms and Conditions govern the use of the website at almonry.sbs and the engagement of services offered by Almonry ("we", "us", "our"), a document support practice based at Jalan Puteri 2/4, 47100 Puchong, Selangor, Malaysia. Please read these terms before using this website or engaging our services. By using this website or submitting an enquiry, you acknowledge that you have read and understood these terms.
1. Definitions
- "Service" refers to the estate document support programmes offered by Almonry, as described on this website.
- "User" means any person who accesses this website or submits an enquiry or engages Almonry for a programme.
- "We/Us/Our" refers to Almonry.
- "Agreement" means the engagement letter or written scope of work issued by Almonry at the commencement of a programme.
- "Content" means all text, information and materials published on this website.
2. Acceptance of Terms
By accessing this website, submitting a contact form or engaging Almonry for a programme, you confirm that you are at least 18 years of age and have the capacity to enter into a binding agreement under Malaysian law. If you are acting on behalf of a family or estate, you confirm that you have authority to do so.
3. Service Description
Almonry provides informational and organisational document support services. Our programmes assist families with sorting estate-related papers, preparing document sets for office submission, coordinating translation and attestation, and establishing family archives. We do not provide legal advice, representation before official bodies, financial services, or any other regulated professional service. Where such services are required, we will say so plainly.
Services are delivered in Malaysia, primarily to families in Selangor and the greater Klang Valley, though arrangements may be made for families in other locations.
4. Engagement and Scope
A service engagement begins when Almonry issues a written scope of work and the client confirms acceptance. The scope sets out the programme, the fees, the duration and the inclusions. No work begins without a confirmed and accepted scope. Changes to scope require written agreement from both parties.
5. User Responsibilities
Users who engage Almonry for a programme agree to:
- Provide accurate and complete information relevant to the scope of work
- Make documents available for sorting, preparation and archiving as agreed
- Notify Almonry of any changes in circumstances that affect the programme
- Use this website and its content only for lawful purposes
- Not reproduce, distribute or commercially exploit content from this website without written permission
6. Fees and Payment
Fees are as stated in the confirmed scope of work. All fees are quoted in Malaysian Ringgit (RM). Payment terms are specified in the scope. For the Household Closure Programme, we are glad to discuss staged payment arrangements. Fees do not increase mid-programme without written agreement. Third-party costs (such as attestation or translation fees) may be charged at cost, and will be disclosed in advance where possible.
7. Intellectual Property
All content on this website, including text, design and structure, is the property of Almonry. You may view and print content for personal, non-commercial reference only. Nothing on this website grants a licence to reproduce or distribute our content commercially. The documents and archives we produce for clients remain the property of the client upon full payment of fees.
8. Disclaimers
The content on this website is provided for general informational purposes only. It does not constitute legal, financial or professional advice of any kind. We make no representations about the suitability of our programmes for any particular estate situation. Outcomes of estate administration depend on legal, financial and regulatory factors outside our scope and control.
9. Limitation of Liability
To the extent permitted by Malaysian law, Almonry's liability in connection with any programme is limited to the fees paid for that programme. We are not liable for any indirect, consequential or incidental losses arising from your use of this website or our services. We are not liable for the conduct or decisions of any legal, financial or government body to whom document sets are presented.
10. Indemnification
You agree to indemnify Almonry against any claims, losses or costs arising from your provision of inaccurate information, your misuse of our services, or your breach of these terms.
11. Termination
Either party may terminate a programme engagement by giving fourteen days' written notice. Where Almonry terminates, fees will be pro-rated to work completed at the date of termination. Where the client terminates, fees paid for completed work are non-refundable. Any materials already produced will be delivered to the client on termination.
12. Dispute Resolution
These terms are governed by the laws of Malaysia. In the event of any dispute, the parties agree to first attempt informal resolution by written correspondence. If informal resolution is not achieved within thirty days, either party may refer the matter to the courts of Malaysia, with jurisdiction in Selangor.
13. General Provisions
- Entire agreement: These terms, together with the confirmed scope of work, constitute the entire agreement between the parties.
- Severability: If any provision of these terms is found to be unenforceable, the remaining provisions continue in full force.
- Waiver: Failure to enforce any term does not constitute a waiver of that term.
- Notices: Formal notices should be sent to the address below or to [email protected].
14. Changes to These Terms
We may update these terms from time to time. The Last Updated date above reflects the most recent revision. Continued use of this website after any change constitutes acceptance of the revised terms. We will not apply updated terms retrospectively to programme engagements already in progress.
